This Privacy Policy is incorporated into and is subject to the innoPath Terms of Service. Your use of the innoPath Services and any personal information you provide on the innoPath Services remains subject to the terms of this Privacy Policy and the Terms of Service.

This statement applies to any innoPath employee, contractor, and third party engaged in innoPath’s operations globally and to any innoPath subsidiary who receive personal data collected through innoPath-branded web sites.

1. Your Privacy Is Not For Sale

innoPath will not share your personally identifiable or client device information or location data with third parties except under the conditions as listed below. Whenever possible, innoPath will release data in an anonymized aggregate form so that it cannot be associated with any individual user.

We are committed to only collecting information that is necessary to provide you with the innoPath Services. The information we collect is stored and associated with your device unless otherwise noted. The innoPath interfaces on your device have options that allow you to update or modify your privacy settings at any time.

We cannot, however, ensure or warrant the security of any information that innoPath receives on your behalf to operate the innoPath Services, or information that you transmit to innoPath — all such receipt or transmission of your information is at your own risk. We also cannot guarantee that such information will not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards.

5. International Visitors

innoPath is a company based in the State of California, USA, with servers housed both in the United States of America (“US” or “United States”) and globally. Personal information collected from users outside the US may be transferred to the US and processed according to US law. innoPath complies with the US, European Union (“EU”), and Swiss Safe Harbor Framework as set forth by the US Department of Commerce regarding the collection, use, and retention of personal information from the EU and Switzerland.

6. Children’s Online Privacy Protection Act Compliance

innoPath does not knowingly collect or store any personal information about children under the age of 13.

7. Change in Control

In the event that innoPath is acquired by or merged with a third party entity, we reserve the right, in any of these circumstances, to transfer or assign the information we have collected from you as part of such merger, acquisition, sale, or other change of control so that the innoPath Services can continue operations. In the unlikely event of our bankruptcy, insolvency, reorganization, receivership, or assignment for the benefit of creditors, or the application of laws or equitable principles affecting creditors’ rights generally, we may not be able to control how your personal information is treated, transferred, or used. You will be notified via notice through the innoPath Services of any such change in ownership or control of your personally identifiable information.
