    GISKAA Terms & Conditions

    This document is an electronic record in terms of Information Technology Act, 2000 and rules there under as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures.

    This document is published in accordance with the provisions of Rule 3 (1) of the Information Technology (Intermediaries guidelines) Rules, 2011 that require publishing the rules and regulations, privacy policy and Terms of Use for access or usage of the GISKAA Mobile App.

    Please read the following terms and conditions very carefully as your use of service is subject to your acceptance of and compliance with the following terms and conditions ("Terms")

    By subscribing to or using any of our services you agree that you have read, understood and are bound by the Terms, regardless of how you subscribe to or use the services. If you do not want to be bound by the Terms, you must not subscribe to or use our services. These Terms and various other policies are binding as per the provisions of the Information Technology (Intermediaries guidelines) Rules, 2011 formulated under the Information Technology Act of 2000.

    In these Terms, references to "you", "User" shall mean the end user accessing the App, its contents and using the Services offered through the App, "Service Providers" mean independent third party service providers, and "we", "us" and "our" shall mean Catena Technologies Private Limited and its affiliates.

    1. Introduction:

    a) The mobile app GISKAA (hereinafter referred to as "App") is owned by Catena Technologies Private Limited a company incorporated under the Companies Act, 1956 with its registered office at 1285, 21 B Main, 11 Cross, Sector 1, HSR Layout, Bangalore, Karnataka, India (hereinafter referred to as "GISKAA" or “GISKAA.com”).

    b) Use of the App is offered to you conditioned on acceptance without modification of all the terms, conditions and notices contained in these Terms, as may be posted on the App from time to time. GISKAA at its sole discretion reserves the right not to accept a User from registering on the App without assigning any reason thereof.

    2. User Account, Password, and Security:

    You will receive a registration email upon completing the App's registration process. You are responsible for maintaining the confidentiality of your password and account, and are fully responsible for all activities that occur under your password or account. You agree to (a) immediately notify GISKAA of any unauthorized use of your password or account or any other breach of security, and (b) ensure that you exit from your account at the end of each session. GISKAA cannot and will not be liable for any loss or damage arising from your failure to comply with this Section 2.

    3. Services Offered:

    GISKAA provides a number of Internet-based services through the App (all such services, collectively, the "Service"). One such service enables users to purchase merchandise such as clothing, footwear, accessories and food items (collectively, "Products"). The Products can be purchased through the App through various methods of payments offered. The sale/purchase of Products shall be additionally governed by specific policies of sale, like cancellation policy, return policy, etc. (which are found on the following URL www.giskaa.com/shipping-returns), and all of which are incorporated here by reference. In addition, these terms and policies may be further supplemented by Product specific conditions, which may be displayed on the webpage of that Product.

    4. Privacy Policy:

    The User hereby consents, expresses and agrees that he or she has read and fully understands the Privacy Policy of GISKAA available in the App under Policies -- Privacy. The user further consents that the terms and contents of such Privacy Policy are acceptable to him or her.

    5. Limited User:

    The User agrees and undertakes not to reverse engineer, modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information or images obtained from the App. Limited reproduction and copying of the content of the App is permitted provided that GISKAA's name is stated as the source and prior written permission of GISKAA is sought. For the removal of doubt, it is clarified that unlimited or wholesale reproduction, copying of the content for commercial or non-commercial purposes and unwarranted modification of data and information within the content of the app is not permitted.

    6. User Conduct and Rules:

    You agree and undertake to use the App and the Service only to post and upload messages and material that are proper. By way of example, and not as a limitation, you agree and undertake that when using a Service, you will not:

    (a) Defame, abuse, harass, stalk, threaten or otherwise violate the legal rights of others;

    (b) Publish, post, upload, distribute or disseminate any inappropriate, profane, defamatory, infringing, obscene, indecent or unlawful topic, name, material or information;

    (c) Upload files that contain software or other material protected by intellectual property laws unless you own or control the rights thereto or have received all necessary consents; you own or control the rights thereto or have received all necessary consents;

    (d) Upload or distribute files that contain viruses, corrupted files, or any other similar software or programs that may damage the operation of the App or another's computer;

    (e) Conduct or forward surveys, contests, pyramid schemes or chain letters;

    (f) Download any file posted by another user of a Service that you know, or reasonably should know, cannot be legally distributed in such manner;

    (g) Falsify or delete any author attributions, legal or other proper notices or proprietary designations or labels of the origin or source of software or other material contained in a file that is uploaded;

    (h) Violate any code of conduct or other guidelines, which may be applicable for or to any particular Service;

    (i) Violate any applicable laws or regulations for the time being in force in or outside India; and

    (j) Violate, abuse, unethically manipulate or exploit, any of the terms and conditions of this Agreement or any other terms and conditions for the use of the App contained elsewhere.

    k) You shall not use any "deep-link", "page-scrape", "robot", "spider" or other automatic device, program, algorithm or methodology, or any similar or equivalent manual process, to access, acquire, copy or monitor any portion of the App or any Content, or in any way reproduce or circumvent the navigational structure or presentation of the App or any Content, to obtain or attempt to obtain any materials, documents or information through any means not purposely made available through the App. We reserve Our right to bar any such activity.

    l) You shall not attempt to gain unauthorized access to any portion or feature of the App, or any other systems or networks connected to the App or to any server, computer, network, or to any of the services offered on or through the App, by hacking, password "mining" or any other illegitimate means.

    m) You shall not probe, scan or test the vulnerability of the App or any network connected to the App nor breach the security or authentication measures on the App or any network connected to the App. You may not reverse look-up, trace or seek to trace any information on any other User of or visitor to App, or any other customer, including any account on the App not owned by You, to its source, or exploit the App or any service or information made available or offered by or through the App, in any way where the purpose is to reveal any information, including but not limited to personal identification or information, other than Your own information, as provided for by the App.

    n) You shall not make any negative, denigrating or defamatory statement(s) or comment(s) about Us or the brand name or domain name used by Us including the terms GISKAA, or otherwise engage in any conduct or action that might tarnish the image or reputation, of GISKAA or our product suppliers or artisans or otherwise tarnish or dilute any of our trade or service marks, trade name and/or goodwill associated with such trade or service marks, trade name as may be owned or used by us.

    o) You agree not to use any device, software or routine to interfere or attempt to interfere with the proper working of the App or any transaction being conducted on the App, or with any other person's use of the App.

    p) You may not forge headers or otherwise manipulate identifiers in order to disguise the origin of any message or transmittal You send to Us on or through the App or any service offered on or through the App. You may not pretend that You are, or that You represent, someone else, or impersonate any other individual or entity.

    q) You may not use the App or any content for any purpose that is unlawful or prohibited by these Terms of Use, or to solicit the performance of any illegal activity or other activity which infringes our rights or others.

    r) You shall at all times ensure full compliance with the applicable provisions of the Information Technology Act, 2000 and rules thereunder as applicable and as amended from time to time and also all applicable Domestic laws, rules and regulations (including the provisions of any applicable Exchange Control Laws or Regulations in Force) and International Laws, Foreign Exchange Laws, Statutes, Ordinances and Regulations (including, but not limited to Sales Tax/VAT, Income Tax, Octroi, Service Tax, Central Excise, Custom Duty, Local Levies) regarding Your use of Our service and Your listing, purchase, solicitation of offers to purchase, and sale of products or services. You shall not engage in any transaction in an item or service, which is prohibited by the provisions of any applicable law including exchange control laws or regulations for the time being in force.

    7. User Warranty and Representation:

    The user guarantees, warrants, and certifies that you are the owner of the content which you submit or otherwise authorized to use the content and that the content does not infringe upon the property rights, intellectual property rights or other rights of others. You further warrant that to your knowledge, no action, suit, proceeding, or investigation has been instituted or threatened relating to any content, including trademark, trade name service mark, and copyright formerly or currently used by you in connection with the Services rendered by GISKAA

    8. Exactness Not Guaranteed:

    GISKAA hereby disclaims any guarantees of exactness as to the finish and appearance of the final Product as ordered by the user. This is especially applicable to all our handicraft and handloom products, which are meticulously handmade by artisans one piece at a time. Due to this process, there may be a slight variations in shape, size and color from one item to the other. Such variations are inherent in the manufacturing of handmade products. Therefore, the Product pictures on GISKAA may not be identical to the Product that you receive.

    9. Intellectual Property Rights:

    a) Unless otherwise indicated or anything contained to the contrary or any proprietary material owned by a third party and so expressly mentioned, GISKAA owns all Intellectual Property Rights to and into the App, including, without limitation, any and all rights, title and interest in and to copyright, related rights, patents, utility models, trademarks, trade names, service marks, designs, know-how, trade secrets and inventions (whether patentable or not), goodwill, source code, meta tags, databases, text, content, graphics, icons, and hyperlinks. You acknowledge and agree that you shall not use, reproduce or distribute any content from the App belonging to GISKAA without obtaining authorization from GISKAA.

    b) Notwithstanding the foregoing, it is expressly clarified that you will retain ownership and shall solely be responsible for any content that you provide or upload when using any Service, including any text, data, information, images, photographs, music, sound, video or any other material which you may upload, transmit or store when making use of our various Service.

    10. Links To Third Party Sites:

    The App may contain links to other websites or apps ("Linked Sites & Apps"). The Linked Sites & Apps are not under the control of GISKAA or the App and GISKAA is not responsible for the contents of any Linked Site & App, including without limitation any link contained in a Linked Site & App, or any changes or updates to a Linked Site & App. GISKAA is not responsible for any form of transmission, whatsoever, received by you from any Linked Site. GISKAA is providing these links to you only as a convenience, and the inclusion of any link does not imply endorsement by GISKAA or the App of the Linked Sites & Apps or any association with its operators or owners including the legal heirs or assigns thereof. The users are requested to verify the accuracy of all information on their own before undertaking any reliance on such information.

    11. Disclaimer Of Warranties/Limitation Of Liability:

    GISKAA has endeavoured to ensure that all the information on the App is correct, but GISKAA neither warrants nor makes any representations regarding the quality, accuracy or completeness of any data, information, product or Service. In no event shall GISKAA be liable for any direct, indirect, punitive, incidental, special, consequential damages or any other damages resulting from: (a) the use or the inability to use the Services or Products; (b) unauthorized access to or alteration of the user's transmissions or data; (c) any other matter relating to the services; including, without limitation, damages for loss of use, data or profits, arising out of or in any way connected with the use or performance of the App or Service. Neither shall GISKAA be responsible for the delay or inability to use the App or related services, the provision of or failure to provide Services, or for any information, software, products, services and related graphics obtained through the App, or otherwise arising out of the use of the App, whether based on contract, tort, negligence, strict liability or otherwise. Further, GISKAA shall not be held responsible for non-availability of the App during periodic maintenance operations or any unplanned suspension of access to the App that may occur due to technical reasons or for any reason beyond our control. The user understands and agrees that any material and/or data downloaded or otherwise obtained through the App is done entirely at their own discretion and risk and they will be solely responsible for any damage to their computer systems or loss of data that results from the download of such material and/or data.

    12. Indemnification:

    You agree to indemnify, defend and hold harmless GISKAA from and against any and all losses, liabilities, claims, damages, costs and expenses (including legal fees and disbursements in connection therewith and interest chargeable thereon) asserted against or incurred by GISKAA that arise out of, result from, or may be payable by virtue of, any breach or non-performance of any representation, warranty, covenant or agreement made or obligation to be performed by you pursuant to these Terms.

    13. Pricing:

    GISKAA strives to provide you with the best prices possible on products you buy or avail of from the App. However, GISKAA does not guarantee that the price will be the lowest in the city, region or geography. Prices and availability are subject to change without notice or any consequential liability to you.

    While GISKAA strives to provide accurate products, services and pricing information, typographical and other errors may occur. In the event that a product or service is listed at an incorrect price or with incorrect information due to an error in pricing or product or service information, GISKAA may, at its discretion, either contact you for instructions or cancel your order and notify you of such cancellation. GISKAA will have the right to modify the price of the product or service and contact you for further instructions via e-mail address provided by you at the time of registration, or cancel the order and notify you of such cancellation. If GISKAA cancels the order after the payment has been processed, the said amount will be remitted to your account from which the payment was made as per the Cancellations, Returns & Refunds Policy.

    Prices for products are described on our App and are incorporated into these Terms by reference. All prices are in Indian rupees

    14. Shipping & Delivery:

    Your shipping address, pin code will be verified with the database of GISKAA before you can proceed to pay for your purchase. In the event your order is not serviceable by our delivery partners or the area is not covered, we would request you to provide us with an alternate shipping address which we expect to have on our partner/merchant's delivery list. In case there is any dispute regarding the shipment of the product or services for the area not covered by GISKAA, in such cases GISKAA will not be responsible for the non-delivery of the product.

    GISKAA do deliver items internationally. However, this service is not available for direct online ordering as of today. Customers would need to write to us at our support email with item specifications and quantities after which the order will be processed offline.

    In case you book multiple items in one order, GISKAA would endeavour to ship all Products together. However, this may not always be possible due to some product characteristics and/or logistics' issues. If you purchase multiple Products in single transaction, then all the Products would be dispatched to a single shipping address given by you. If you wish to ship Products to different addresses, then you should book the orders separately based on the delivery addresses.

    15. Termination:

    a) GISKAA may suspend or terminate your use of the App or any Service if it believes, in its sole and absolute discretion that you have breached, violated, abused, or unethically manipulated or exploited any term of these Terms or anyway otherwise acted unethically.

    b) Notwithstanding Section 14.a above, these Terms will survive indefinitely unless and until GISKAA chooses to terminate them.

    c) If you or GISKAA terminates your use of the App or any Service, GISKAA may delete any content or other materials relating to your use of the Service and GISKAA will have no liability to you or any third party for doing so.

    d) You shall be liable to pay for any Service or product that you have already ordered till the time of Termination by either party whatsoever.

    16. Governing Law:

    These terms shall be governed by and constructed in accordance with the laws of India without reference to conflict of laws principles and disputes arising in relation hereto shall be subject to the exclusive jurisdiction of the courts at Bangalore.

    17. Severability:

    If any provision of the Terms is determined to be invalid or unenforceable in whole or in part, such invalidity or unenforceability shall attach only to such provision or part of such provision and the remaining part of such provision and all other provisions of these Terms shall continue to be in full force and effect.

    18. Report Abuse:

    As per these Terms, users are solely responsible for every material or content uploaded on to the App. Users can be held legally liable for their contents and may be held legally accountable if their contents or material include, for example, defamatory comments or material protected by copyright, trademark, etc. If you come across any abuse or violation of these Terms, please report to reportabuse@GISKAA.com

    19. Charges:

    Use of the App is free for buyers. GISKAA will not charge any fee for using the App and making purchases using the App. GISKAA reserves the right to change this fee from time to time. GISKAA may at its sole discretion introduce new services and modify some of the existing services offered through the App. In such an event, GISKAA reserves the right to introduce fees for the new services offered or update/introduce fees for existing services, as the case may be. Changes to the fees shall be intimated to the users of the App.

    PayUmoney Offer Terms and Conditions

    1. Customers will receive 20% (“Cashback Amount”) cashback in their PayUmoney Wallet issued by RBL (“PayUmoney Wallet”) subject to a maximum of Rs.75 per transaction on payments made in the GISKAA App through their PayUmoney Account ("Offer"). This Cashback Offer can be availed only when payments are made by the Customer through the PayUmoney payment option on the payment page of the App.

    2. In order to avail the cashback, the customer must be registered as a PayUmoney Buyer and should hold a PayUmoney Wallet.

    3. The Offer can be availed once by a PayUmoney Account Holder through one device only. The Cashback Amount will be received in the PayUMoney Account Holder’s PayUmoney Wallet after 24 hours of the Transaction being made.

    4. The Offer will be valid on 8st August, 2015 00:00 hrs to 17th August, 2015 23:59 hrs.

    5. The Cashback Amount received in the PayUmoney Wallet can be used by the customers on all websites where the PayUmoney is available as a payment option

    6. In the event of a full or partial refund, the whole or part cashback shall be deducted from the customers PayUmoney wallet account. In case the customers PayUmoney Wallet has zero balance then the account shall be in negative and will be adjusted as soon as the cashback or refund is deposited in the customers PayUmoney Wallet

    7. This Offer cannot be clubbed with any other offer/promotion being run by PayUmoney.

    8. PayUmoney does not warrant or guarantee availability, merchantability, quality, fitness etc., of any product or service offered on the GISKAA App.

    9. PayUmoney reserves the right to, at any stage and at its discretion, modify/change or alter the Offer. PayUmoney also reserves the right to modify/change all or any of the terms applicable to the Offer and to discontinue the Offer without assigning any reasons or without any prior intimation whatsoever.

    10. PayUmoney reserves the right to disqualify any customer from the benefits of the Offer, in case of any fraudulent activity/suspicious transactions or misuse of the Offer in any way.

    11. Any disputes will be subject to the exclusive jurisdiction of the competent courts of New Delhi.

    12. In all matters relating to the Offer, PayUmoney’s decision will be final.

    13. In addition to the above, the Offer is also subject to PayUmoney general terms & conditions available on www.payumoney.com.

    14. All capitalized terms used but not defined herein shall have the respective meanings ascribed to them in the PayUmoney User Terms and Conditions.

    15. Terms & conditions on the GISKAA App shall also apply.

    GISKAA Privacy

    1. GENERAL PRINCIPLES

    Protecting your privacy is very important to us. This Privacy Policy has been accordingly developed to protect your personal information and keeping it confidential. We have built our systems and processes to protect your privacy on systems and the GISKAA App which are directly controlled by us. However, we are not liable for any unauthorized or unlawful disclosures of your personal and confidential information made by third parties who are not subject to our control, for example other websites or apps that have links to the GISKAA App. You should take note that the information and privacy practices of our business partners, advertisers, sponsors or other sites to which we provide hyperlinks, may be different from ours. Our privacy policy is subject to change at any time without notice. To make sure you are aware of any changes, please review this policy periodically.

    Your information (collectively referred to as "Personal Information") is categorized as follows:

    (a) Profiling Information: Information which you provide when you register as a user, which may include some or all of the following: Information about your personal identity such as gender, marital status, age, preferences, likes and dislikes etc.; Your contact details such as your physical addresses, postal addresses, telephone numbers and the like. In the case of log in via Facebook or Google+ (if so opted by you), publicly available information of yourself, your friends, their likes and dislikes, etc.

    (b) Payment and Account Information: Your account history with us including (without limitation) all billing information and communications, payment history etc. We maintain this in encrypted form on secure servers.

    (c) Service Usage: Information about your navigation through the App, screens that you visit and products that you view.

    (d) Log information: Information such as your request, devices used, IP address, browser type, browser language, date and time of request.

    (e) Transactional Information: Transactional history (other than banking details) about your e-commerce activities.

    (f) Correspondence Information: Content, information about your correspondence, and the destination/origin of communications between you and any other person using our Services, which include email communications, blog, and discussion board communications, experts forum communications, membership of newsletters etc.

    (g) User IDs: Your usernames, passwords, email addresses and other security-related information used by you in relation to our Services.

    (h) Stored Information: Data either created by you or by a third party and which you wish to store on our servers such as image files, documents etc.

    We only collect your Personal Information to conduct our business and to enable us to deliver and improve our Services. We do not for any reason whatsoever, sell your Personal Information to any third party or otherwise trade on it.

    We will only disclose your Personal Information in accordance with this Privacy Policy. If we want to use it for any other purpose, we will obtain your prior written consent. If you decline to submit personal information to us, then we will unfortunately not be in a position to provide the Services to you. Any of your information which you provide when you use certain Services and are to an open, public environment or forum including (without limitation) any blog, community or discussion board, is not confidential, does not constitute Personal Information, and is not subject to protection under Privacy Policy. Since such public environments are accessible by third parties, it is possible that third parties may collect and collate and use such information for their own purposes. You should accordingly be careful when deciding to share any of your Personal Information in such public environments. Information, which is disclosed publicly, is also shared with our affiliates, third party service providers, sponsors of competitions etc. unless expressly stated otherwise. We are not liable to you or any third party for any damages that you or any third party may suffer howsoever arising from your disclosure of Personal Information in any public environment. You accordingly disclose information in a public environment at your own risk.

    2. RIGHT TO COLLECT

    By accepting the Terms of Service you agree that we may collect and store your Personal Information as long as you use our Services subject to the limitations set out in this Privacy Policy.

    2.1 We collect your Profiling Information and Payment and Account Information for the following reasons:

    (a) We need your identity details, contact details, and account history to manage our relationship with you and provide Services to you. We may use this information for suggesting products and promotional offers and schemes.

    (b) We use certain parts of your information in an aggregated form to compile statistical and demographical profiles for our business and marketing activities. We will not disclose any of your information that is capable of being used or interpreted in such a manner as to identify you.

    2.2 We collect and store your Service Usage and Transactional Information to:

    (a) Determine and verify the Service Charges payable by you and to administer our relationship with you.

    (b) Comply with any statutory or regulatory requirement.

    (c) Compile statistical and demographical profiles about you for our business and marketing activities and to customize our Services to you. While we are entitled to use such information about you for our own internal business purposes without limitation, we will not disclose any of your information which can be used or interpreted in such a manner as to identify you; and

    (d) Monitor your use of our Services for the purposes of ensuring compliance with our Terms & Conditions.

    2.3 We collect and store your Correspondence Information and Personal Identifiers to:

    (a) Comply with our obligations under law; and

    (b) Monitor your use of our Services in order to ensure your compliance with our Terms & Conditions.

    Please note that when you place an order, some of your Personal Information will be passed on to the others who shall need to have access to some Personal Information like courier companies, credit card processing companies, vendors etc. to enable them and GISKAA.com perform their duties and fulfill your order requirements.

    Any Personal Information which we collect and which we may use in an aggregated format ensuring you are not individually identified is our property. We may use it, in our sole discretion and without any compensation to you, for any legitimate purpose including (without limitation) the commercial sale thereof to third parties.

    Sometimes we use "cookies" so that we can provide you with more customized information when you return to our App. "Cookies" are used to store user preferences and to track user trends, so as to enhance your interactive experience and generally improve our Services to you. You can set your browser to notify you when you are sent a "cookie", giving you the chance to decide whether or not to accept it. If you do accept a "cookie", you thereby agree to our use of any Personal Information collected by us using that Cookie.

    You may update your Profiling Information at any time on the App. You acknowledge and agree that in the interests of improving personalization and Service efficiency, we may, under controlled and secure circumstances, share your Personal Information with our affiliates (an entity which is our subsidiary or holding company or a subsidiary of our holding company or an entity which controls, is controlled by or is under common control with us).

    3. GENERAL EXCEPTIONS

    If we are required to intercept, disclose, monitor and/or store your Personal Information: (a) by law; (b) to conduct our business; (c) to secure our systems; or (d) to enforce our own rights, we will do so in the manner as prescribed by law.

    Such interception, disclosure, monitoring and storage may take place without your knowledge. In that case, we will not be liable to you or any third party for any damages howsoever arising from such interception, disclosure, monitoring and storage. In order to ensure that all our Users comply with the Terms & Conditions, we may monitor your Personal Information to the extent that this may be required to determine compliance and/or to identify instances of non-compliance. To ensure that the security and integrity of our Services are safeguarded, we may monitor your Personal Information. This monitoring may include (without limitation) the filtering of incoming and outgoing electronic data messages to identify, limit and/or prevent the transmission of spam, viruses and/or unlawful, defamatory, obscene or otherwise undesirable material or content. We may under certain circumstances procure an element of the Services from a third party service provider. To the extent that it may be necessary, and solely for the purposes of providing the Service to you, you agree that we may disclose to such third party any of your Personal Information that may be necessary for the procurement of services from the third party.

    BY USING THIS APP, YOU SIGNIFY YOUR AGREEMENT TO THE TERMS OF THIS PRIVACY POLICY, GISKAA RESERVES THE RIGHT, IN OUR SOLE DISCRETION, TO CHANGE, MODIFY, ADD OR DELETE PORTIONS OF THE TERMS OF THIS PRIVACY POLICY AT ANY TIME.

    GISKAA Shipping, Returns & Cancellations

    1. GISKAA delivers to all the major cities and towns within India. However, we advise you to use the 'Check Pincode For Delivery' option available on each product's page and verify whether your delivery pincode is covered before proceeding to purchase an item

You may use any international Visa/Mastercard/Amex credit card to make the payment.Please note that there are certain items which are restricted for international shipping, e.g. certain food items, depending on the destination country.

    3. Your shipping address, pin code will be verified with the database of GISKAA before you can proceed to pay for your purchase. In the event your order is not serviceable by our delivery partners or the area is not covered, we would request you to provide us with an alternate shipping address which we expect to have on our partner/merchant's delivery list. In case there is any dispute regarding the shipment of the product or services for the area not covered by GISKAA, in such cases GISKAA will not be responsible for the non-delivery of the product.

    4. Free shipping is applicable if the total order value is Rs 1,000 or more. For individual items priced below Rs 1,000 you will see the note "Free shipping not applicable for this item" on the product page. However, once the total order value of your shopping cart is Rs 1,000 or more, shipping costs will be automatically waived off. You can verify this by viewing your Shopping Cart.

    Free shipping is valid only for shipping within India.

    5. In case you book multiple items in one order, GISKAA would endeavor to ship all Products together. However, this may not always be possible due to some product characteristics and/or logistics' issues. If you purchase multiple Products in single transaction, then all the Products would be dispatched to a single shipping address given by you. If you wish to ship Products to different addresses, then you should book the orders separately based on the delivery addresses.

    Cancellations

    1. Cancellation by Customer:

    (a) Orders can be cancelled any time before an item has been dispatched from the supplier. Once the status of an item changes to “Order Confirmed”, a cancellation is no longer permitted on that item. You will also receive an SMS and Email on your registered mobile number and email address once an order is confirmed.

    (b) In case of requests for order cancellations, GISKAA reserves the right to accept or reject requests for order cancellations for any reason whatsoever.

    (c) Once your order cancellation request is approved by GISKAA, the refund process will be initiated as per the Returns & Refunds Policy section below.

    2. Cancellation by GISKAA:

    (a) There may be certain orders that GISKAA is unable to accept and must cancel. GISKAA reserves the right, at GISKAA's sole discretion, to refuse or cancel any order for any reason whatsoever. Some situations that may result in your order being cancelled include, without limitation, non-availability of the product or quantities ordered by you, non-availability of the service, inaccuracies or errors in pricing information, or problems identified by GISKAA's credit and fraud avoidance department.

    (b) GISKAA may also require additional verifications or information before accepting any order. GISKAA will contact you if all or any portion of your order is cancelled or if additional information is required to accept your order.

    (c) If your order is cancelled, the refund process will be initiated as per the Returns & Refunds Policy section below.

    (d) GISKAA reserves the right to cancel any orders that classify as 'Bulk Order' as determined by GISKAA as per certain criteria. An order can be classified as 'Bulk Order' if it meets with the below mentioned criteria, which may not be exhaustive:

    i. Products ordered are not for self-consumption but for commercial resale

    ii. Multiple orders placed for same product at the same address

    iii. Bulk quantity of the same product ordered

    iv. Invalid address given in order details

    v. Any malpractice used to place the order

    Returns & Refunds

    1. In the event you receive a damaged/defective product or a product that does not comply with the specifications as per your original order, you can initiate a return by clicking the “Return Items” button in the Orders section of My Account. Fill out the required details correctly in the form and then click “Submit Return Request”.

    2. Items can be returned within 7 days of delivery of the item. The "Return Items" button will not be available in the Orders section of My Account after 7 days of delivery of the item to you.

    3. Upon receiving your return request, GISKAA shall verify the authenticity and the nature of the complaint and if GISKAA is convinced that the complaint is genuine, GISKAA will initiate either a replacement or a refund depending on the option that you selected on the Returns form. However, in the event of frivolous and baseless complaints regarding the quality and content of the products, GISKAA reserves the right to take necessary legal actions against you and you will be solely liable for all costs incurred by GISKAA in this regard.

    4. Before accepting shipment of any product, kindly ensure that the product's packaging is not damaged or tampered. If you observe that the package is damaged or tampered, we request you to refuse to accept delivery and inform GISKAA at the earliest. The return process of the product may be restricted by GISKAA depending on the nature and category of the product.

    5. In order to return any products sold through the App, You are required to comply with the mentioned conditions below:

    (a) Please notify GISKAA of receipt of a damaged or defective product within 48-hours of delivery to you. If you are unable to do so within 48-hours, GISKAA shall not be held liable for the failure to replace the order;

    (b) Products should be unused;

    (c) GISKAA will arrange pick-up of the damaged/defective product through its own logistics partner;

    (d) Products should be returned in their original packaging along with the original price tags, labels, barcodes and invoices etc.;

    (e) It is advised that the return packets should be strongly and adequately packaged so that there is no further damage of products during transit;

    (f) The returned products are subject to verification and checks by GISKAA in order to determine the legitimacy of the complaint/ return.

    6. In the event the return of a product is duly accepted by GISKAA, the value of such product, as originally paid by you during acceptance of delivery of product or otherwise, will be refunded to you. Refund will be processed based on the mode of payment and GISKAA or the approved payment gateway will credit your refunds directly into your debit/credit card or online accounts or provide you with a cheque in this regard. Refunds will be subject to the following:

    (a) Orders paid online will be refunded within 5-21 working days through the online account or via cheque, depending on the then current circumstances as determined by GISKAA.

    (b) If the original payment method you used to make the payment (credit/ debit card) is no longer valid, we'll issue the refund through a demand draft. When we receive a payment failure notice from your bank, we will send you an e-mail asking you to call us. When you call us back, we will collect your name and the address where you want the demand draft to be sent, and proceed with the refund.
